Official Notice

Morgan County Board Files Suit Against KSBIT and KLC.  

The Morgan County Board of Education has authorized the filing of a lawsuit against the districts past insurer KSBIT and KLC.  

Morgan County will be the second school system to file suit concerning tornado damaged schools.  

Magoffin County Schools filed suit last December and came to an out of court settlement in August with the now defunct insurer.  

The contention in Magoffin County was that the company did not want to cover expenses related to building losses and the expenses for building back district facilities.  

The Morgan County Board is contending the same stating that the company would cover the costs associated with rebuilding destroyed district facilities.  

For example KSBIT only offered the district fifty percent of what it would cost to rebuild the Morgan County Central Office and only sixty percent of what it would cost to rebuild the Morgan County Cougar Den. 

In addition, KSBIT also balked at paying for demolition and clean-up costs at the West Liberty Elementary School site, where school officials estimate the total site cleanup could run as high as $500,000. 

"Our engineers tell us the WLES building is not structurally sound,” Chairman Jenkins said. “The KSBIT engineers say it is, so the building’s status has been in contention.”

Board members agreed during the meeting that they did not want to pass these costs on to taxpayers.

Superintendent Barnett said "The district had been trying to reach an out of court settlement with the agencies but the last couple of weeks their representative has ignored repeated requests for a final settlement offer to the board."  Mrs Barnett also said "That astounds me because their representative brought the final settlement format to the negotiating table and pushed for that concept only to with hold a final settlement offer."
